Empty Container Policy
RCRA Regulations
The empty container provision, found in Title 40 of the Code of Federal Regulations in Section 261.7, exempts from regulation hazardous waste residues that remain in drums or other containers if a number of conditions are met. One of the conditions is that all wastes must be removed from the containers by pouring, pumping, aspirating, etc. There are different conditions to be met in order to deem a container empty for non-acute hazardous waste and for acute hazardous waste. Containers that meet the conditions of this exemption are typically referred to as “RCRA empty” containers.
If the regulations are followed correctly by all generators of used drums, only completely empty or “RCRA empty” containers are shipped to drum reconditioners to be cleaned, restored, tested, and reused. Despite this exemption, drum reconditioners are still receiving containers that do not meet the conditions of 40 CFR Section 261.7 and are likely accepting many drums of hazardous waste that are not actually “RCRA empty.” Additionally, even if drum reconditioners receive only “RCRA empty” containers, they may still receive and manage significant quantities of cumulative hazardous waste residues because of the sheer volume of containers they process. As a result, these facilities are potentially managing large quantities of hazardous waste without a provision in the regulations that allows drum reconditioners to store rejected non-empty hazardous waste containers and without being subject to substantive RCRA hazardous waste regulations.

You (the Buyer / Container User) shall be responsible for determining whether the containers supplied by Harbison Bros., Inc. are suitable and safe for the materials being placed in them, for determining the proper methods for filling the containers, and the correct closures to be used on the containers, taking into account the likely storage and use of the filled containers by the buyer / container user, and also any further ultimate end-user.
HB Shipping/Freight Charges, Claims, & Return
Less Than Case Handling Charges are applicable whenever less than a full case of any item is ordered. A $5.00 repackaging/handling charge will be applied for each case required to repack your items.

Shipping Claims for missing items or damage caused in transit should be notified to Harbison Brothers, Inc. immediately upon receipt of the goods. Any delays in notification may cause increased time for resolution. Make sure you carefully document the missing or damaged goods, as well as taking digital photos of any damage.
Returns will not be accepted without proper return authorization from Harbison Brothers, Inc. It is the general policy is that drums, totes and other containers ONLY be returned for reconditioning services or disposal, which there is a charge. If you require a return please contact HB customer service at (716) 892-3290
the return must be requested within 10 days of date of purchase
There is a restocking fee of 25% of the invoiced amount
the remaining 75% of the invoice will be carried as a credit to your account for 1 year from date of purchase
